Were you born outside Canada but have a Canadian grandparent? You may now have a pathway to citizenship. In March 2025, the federal government introduced interim measuresĀ to help people affected by the first-generation limit (FGL)Ā apply for a discretionary grant of Canadian citizenship.
š¼ Whatās the First-Generation Limit?
Back in 2009, Canada changed its Citizenship Act so that only the first generationĀ born abroad could automatically inherit citizenship. This left many children and grandchildren of Canadians without a direct claim.
In 2023, the Ontario Superior Court ruled this rule unconstitutional. While the government works on a permanent fix, temporary measures are in place to support families caught in the gap.
š How the Process Works
If you were born outside Canada and have a Canadian grandparent, you may qualify.
Start by applying online for proof of citizenship.
Immigration, Refugees and Citizenship Canada (IRCC) will review your case.
If youāre affected by the FGL, you may be invited to apply for a discretionary grant of citizenship.
IRCC also offers a quick online questionnaire to check if youāre impacted.
š Why This Matters Now
The current grace period runs until November 20, 2025. Meanwhile, Bill Cā3āCanadaās proposed fixāis moving through Parliament. If passed, it would allow exceptions where a Canadian parent shows a strong connection to Canada (at least 1,095 days in the country within any fiveāyear period before their childās birth or adoption). Applicants aged 18+ may also need to pass a security check.
